Purchasing a property in Italy is a process governed by precise regulations, requiring attention, expertise and careful management at every stage. Understanding the process allows buyers to approach the transaction with greater confidence and peace of mind.
The process generally begins with the purchase proposal / preliminary sale agreement, a single document formalising the agreement between the parties and defining the conditions, timing and purchase price. Once accepted, the proposal becomes legally binding for both parties.
At this stage, a holding deposit is generally paid to protect both parties: in the event of non-compliance, Italian law provides for specific financial consequences.
The buyer then appoints the Notary, as Italian legislation states that the purchaser is responsible for the related notarial costs. The Notary’s role is to ensure the legal security of the transaction, verifying that the property is free from mortgages, liens or other encumbrances, and preparing the final deed of sale.
From a tax perspective, the treatment varies depending on the type of purchase:
- Purchase from a Private Seller:
- Registration tax of 2% on the cadastral value for a primary residence
- Registration tax of 9% for a second home
- Purchase from a Developer
- VAT of 4% of the selling price, for a primary residence
- VAT of 10% of the selling price, for a second home
(with further specifications provided by current legislation)
The final deed of sale concludes the process and formally transfers ownership.
Relying on a qualified real estate agency is essential to ensure every stage is handled correctly: from the drafting of the proposal to coordinating relationships between the parties, liaising with the Notary and supervising the entire process. Professional guidance reduces risks, prevents complications and allows buyers to proceed with greater peace of mind.
